The Supreme Court has granted leave to proceed with the Fundamental Rights petition filed by Inter-University Students’ Federation (IUSF) activist Hashan Jeewantha Gunathilake for violating his fundamental rights declared and recognized by the constitution.
Hashan Jeewantha Gunathilake, an undergraduate who became an active participant in the “Gota Go Gama” protests, filed a fundamental rights petition through attorney-at-law Manjula Balasooriya, challenging the legality of the detention order issued against him under the Prevention of Terrorism Act (PTA).
The Supreme Court’s three-judge bench, comprising Justices S. Thurairaja, Mahinda Samayawardena, and Priyantha Fernando, granted leave to proceed with the petition for violating fundamental rights recognized by Articles 12(1) and 13(1) of the constitution.
The petitioner is seeking a declaration that Gunathilake’s arrest and detention under PTA are unlawful.
The petitioner is challenging the legality of Gunathilake’s arrest and detention under Detention Orders issued by President Ranil Wickremesinghe in his capacity as the Minister of Defense.
The petitioner has named IGP Chandana Wickremaratne, CID Director Kavinda Piyasekera, Director of TID Prasanna Alwis, Attorney General and several others as respondents.
