The Court of Appeal today issued an Interim Order preventing the Commissioner of Local Government of Sabaragamuwa Province from holding a meeting to fill the office of Chairman of the Mawanella Pradeshiya Sabha.

The Court of Appeal made this order pursuant to a writ petition filed by Chairman of the Mawanella Pradeshiya Sabha Chandana Kumara Jayawandala.

This interim order will be effective until February 3.

The Petitioner states that from the time he was elected Chairman, with the support of the members of the SLFP and the UNP, the functions and affairs of the MawanellaPradeshiya Sabha were conducted efficiently and transparently to the satisfaction of the people of the area.

The Petitioner states that after the 2019 Presidential Election, with the political alignment between the SLFP and the Sri Lanka Podujana Peramuna, the members of the Mawanella Pradeshiya Sabha aligned to remove him from the office of Chairman of the Mawanella Pradeshiya Sabha as he was a member of the UNP.

Petitioner further states that SabaragamuwaProvince Governor by an Order published in Government Gazette (Extraordinary) dated 15.01.2022 announced that Petitioner “is considered to have resigned” the post of Chairman of the Mawanella Pradeshiya Sabha with effect from December 31, 2021 due to failure to pass the Budget prepared by the Petitioner for the year 2022.

Court of Appeal bench comprised Justice Sobhitha Rajakaruna and Justice DhammikaGanepola.
