Allows the petitioners to carryout remaining work
The Colombo Commercial High Court has issued an enjoining order preventing four contractors together with former Minister Daya Gamage’s ‘Olympus’ construction company from preventing the Road Development Authority from taking possession of the Site, Stage II of the Central Expressway from Mirigama to Kurunegala.
Accordingly, the Court issued an enjoining order preventing four contractors, a joint venture known as Sierra-Olympus-Tudawe–CEC from, preventing the Road Development Authority, ICC-Access (Nawaloka-KDESH JV) and KDAW- NEM-E&C- Consortium from carrying out the remaining works of Package B of Stage II of the Central Expressway.
Commercial High Court Judge M.A.R. Marikkar made this order according to a lawsuit filed by Road Development Authority and its Chairman Chaminda P. Athuluwage.
The plaintiffs alleged that Contractors are nowhere near completion as per the extension of time granted.
The plaintiffs stated that the period for completion in terms of the progress made as per the latest assessment by the Project Engineer is flagged as ‘uncertain’. As a result of the said uncertainty of the time for completion, the RDA is unable to complete Stage II of the Central Expressway from Mirigama to Kurunegala.
In 2017, tenders had been awarded to a joint venture known as Sierra-Olympus-Tudawe – CEC by RDA for the Construction of Central Expressway Project Stage II.
The case will be taken up, again on June 9.
