The Colombo District Court today decided to dissolve its previous enjoining, issued against Sri Lanka Freedom Party (SLFP) Chairman Maithripala Sirisena.
The Court had earlier issued an enjoining order preventing the operation of an explanation letter sent by SLFP Chairman Maithripala Sirisena to SLFP former General Secretary Dayasiri Jayasekara.
Former President Maithripala Sirisena through his lawyer Faiszer Musthapha made a request to dissolve the enjoining order stating that this order had been obtained by concealing material facts to the case. Musthapha contended that his client had issued this explanation letter with the approval of the party’s central committee. Taking into consideration the facts, Colombo District Court Judge Sandun Vithana decided to dissolve the enjoining order which was issued against SLFP office bearers.
In his plaint, Parliamentarian Dayasiri Jayasekara had challenged the legitimacy of the letter dated September 18, 2023 issued by SLFP Chairman and former President Maithripala Sirisena, calling for explanations prior to taking disciplinary action against him on several allegations. He contended that the party Chairman is not vested with any power by the party constitution to issue such a letter in an arbitrary manner.
