The Colombo Commercial High Court today decided to vacate its Enjoining Order preventing two siblings of the Jaya Sri Musical band from releasing, singing, or promoting online 20 songs from its two new albums ‘Mod Goviya’ and Sundariye’.

The Court had earlier issued an Enjoining Order against two members of the Jaya Sri Musical band Rohitha Jayalath and Rohana Jayalath (siblings) under a lawsuit filed under Intellectual Property Law by Aruna Liyanage, a former member of Jaya Sri Music band.

The two siblings, the defendants of the case had made an application to revoke the enjoining order arguing that the order had been issued contrary to the legal provisions.

After considering the facts presented by the parties, Colombo Commercial High Court Judge Priyantha Fernando decided to vacate the Enjoining Order and fixed further hearing of the case for May 27.

‘Jaya Sri’ musical band was popular with their literal mixed reggae, hip hop style modern infusion in taking Western and Sinhala music.

The plaintiff Aruna Liyanage stated that he along with the two defendants had formed this musical band. He alleged that the Jayalath twins have created two albums named ‘Mod Goviya’ and Sundariye’ without his consent contrary to the provisions of Intellectual Property. Act, No. 36 of 2003.
