The case against Nivard Cabraal was dismissed by the Colombo Chief Magistrate

The Colombo Chief Magistrate's Court today dismissed a private lawsuit filed against former Central Bank Governor Ajith Nivard Cabraal.   Colombo Additional Magistrate Harshana Kekunawala made this order, taking into consideration the preliminary objections raised on behalf of the former Central Bank Governor.   Former Southern Province Governor Rajith Keerthi Thennakoon had filed a private complaint in terms of Section 136(1)(a) of the Code of Criminal Procedure Act seeking legal action against Cabraal for committing alleged offences while he was serving as the Governor of the Central Bank of Sri Lanka.   President’s Counsel Sampath Mendis, appearing for Ajith Nivard Cabraal, had raised preliminary objections challenging the maintainability of the complaint on the grounds of insufficient evidence to support the allegations and concealing material facts, to the effect that a petition filed over similar allegations has been dismissed by the Court of Appeal.   In this case, petitioner Keerthi Thennakoon alleged that Cabraal is responsible for the country's crippling economic crisis since he took measures to pay a 500 million US dollar sovereign bond to the investors.
