The Attorney General has advised that the Public Utilities Commission is required to implement the amended policy guidelines on electricity tariffs.
"The Public Utilities Commission is obligated and duty-bound to implement the revised policy guidelines on electricity tariffs." he said in a communication to the ministry.
The Attorney General opines that, in terms of the Public Utilities Commission Act, the PUCSL should act when such amended guidelines have been approved by the Cabinet of Ministers.
Addressing the Secretary to the Ministry of Power and Energy, M.P.D. U.K. Mapa Pathirana, the Attorney General has clarified the powers vested in the Minister of Power and Energy on the revision of electricity tariffs.
He further says the authority of the minister to formulate general policy guidelines on pricing is also recognized in Section 30(1) of the Public Utilities Commission Act.
In the meantime, the minister has obtained Cabinet approval to amend general policy guidelines and to inform the PUCSL to implement the new electricity tariff proposal in accordance with the revised general policy.
