The Puttalam District Court has issued an enjoining order preventing Archchikattuwa Pradeshiya Chairman Sabha K. Thachchanamoorthy from entering and interfering with the business of a prawn farm.
Puttalam District Judge F.S. Mahfi made this order consequent to a civil action filed by a leading private company in Chilaw engaged in the business of prawn farming.
The plaintiff company alleged that the plaintiff’s company is in possession of land situated in Udappuwa in which the plaintiff company has invested a large sum of money by utilising local and foreign investors for the purpose of carrying on the business of a shrimp farm and a hatchery.
A group of people, under the directions of K. Thachchanamoorthy, Chairman, Arachchikattuwa, Pradeshiya Sabah, had recently entered the premises belonging to the Plaintiff Company in a wrongful and unlawful manner and had threatened the staff to cease all business operations and to immediately handover the property to the Pradeshiya Sabha Chairman. Furthermore, the said group of people have threatened that if they do not, they will set fire to the said property, building, and the machinery situated therein.
The plaintiff’s lawyers argued in court that, given the circumstances, there was an imminent risk of the plaintiff losing possession of the property, which would have had a serious impact on the plaintiff’s current operations at the property.
The lawyers further submitted that in the event of such dispossession, grave loss and damage would be caused to the plaintiff and its business.
It was also submitted to the Court that the Udappuwa Police had failed to act on the complaint of the Plaintiff in this regard.
Having considered the submissions, the court issued an enjoining order preventing the Pradeshiya Sabha Chairman or his agents from entering the said property and interfering with the business of the prawn farm and hatchery carried on on the said property.
The court also issued a notice to the defendant to be present in court on October 19th, 2022.
