The Putthalam High Court today enlarged on bail three accused under the new amendment to the Prevention of Terrorism Act.

The three accused the Principal and two teachers of the Al – Zuhriya Arabic College in Puttalam were indicted in the Puttalam High court in a case connected to Attorney-at-Law Hejaaz Hizbullah. They were indicted by the Attorney General for aiding and abetting to conduct lectures on extremism at the college.

Each of the accused were ordered to be released on a cash bail of Rs.100,000 with two surety bail by Puttalam High Court Judge Nadee Aparna Suwandurugoda. Ordering to release the accused on bail, the High Court judge observed that remanding a person cannot be construed as a punishment since court can satisfy with the exceptional circumstances.

President’s Counsel Maithree Gunaratne appearing with Charitha Gunarathne submitted to court that there is no prima facie case against the accused. Defence counsel further stated that the accused were arrested years after the alleged incident and have remained incarcerated on flimsy and contradictory evidence.

Meanwhile, State Counsel Jehan Gunasekara objected to bail being granted. The trial was fixed for July 1, 2022.

Earlier, the accused filed fundamental rights applications alleging torture and being forced by the CID to implicate Hejaaz Hizbullah.
